1. Our Partnership & Educational Purpose

• Built for Educators: TiTo Tracker is designed exclusively for educational centers, instructors, and authorized assistants to manage student attendance, class schedules, library books, and parent conferences.
• Legitimate Use: You agree to use the platform solely for lawful, legitimate classroom administration and student management.
• Community Standards: You will not use the service to harass others, upload malicious software, attempt unauthorized access to other centers' accounts, or share your master account credentials outside your authorized center staff.

2. Your Data, Student Privacy & Ownership

• You Own Your Data: You retain 100% ownership of all student records, roster information, and conference notes entered into your account. TiTo Tracker does not claim ownership of your classroom data, nor do we ever sell or monetize student information.
• Our Platform Ownership: TiTo Tracker owns all rights, title, software, algorithms, user interface designs, and intellectual property associated with the TiTo Tracker platform.
• Confidentiality & Compliance: You are responsible for ensuring that your collection of student names and attendance records complies with applicable local, state, and national educational privacy standards.
• Assistant Accounts: If you create assistant accounts, you are responsible for ensuring your staff adheres to these privacy standards and data confidentiality.

3. Subscriptions, Billing & Cancellations

• No Long-Term Contracts: TiTo Tracker operates on a month-to-month or annual subscription basis. There are no long-term lock-in commitments.
• Secure Billing via Stripe: All payments, billing details, and subscription changes are processed securely through Stripe. TiTo Tracker never stores your raw credit card numbers.
• Hassle-Free Cancellation: You are free to cancel your subscription at any time directly through your billing settings. Upon cancellation, your access remains active until the end of your prepaid billing period.

4. Service Availability, Maintenance & Backups

• Reliability Commitment: We work hard to ensure TiTo Tracker is fast, reliable, and available whenever your classroom is in session.
• Routine Maintenance: To deliver improvements and security updates, occasional maintenance windows or brief downtime may occur. Wherever possible, we schedule major updates outside standard classroom operating hours.
• Data Safeguards: While we maintain automated database backups and robust infrastructure safeguards, unexpected hardware issues, network interruptions, or unforeseen technical failures can occur. You agree that TiTo Tracker and its managing entity will not be held liable for temporary service interruptions or accidental data loss.

5. Limitation of Liability & "As-Is" Provision

• "As-Is" Service: TiTo Tracker is provided on an "as-is" and "as-available" basis without express or implied warranties of any kind.
• Limitation of Damages: To the maximum extent permitted by applicable law, in no event shall TiTo Tracker, its operators, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or business interruption) arising from your use or inability to use the platform.
• Liability Cap: Our total aggregate liability for any claims arising under these Terms shall not exceed the total fees you paid to TiTo Tracker during the twelve (12) months preceding the claim.

6. Independent Service Disclaimer

• TiTo Tracker is an independent classroom management tool. Any reference to educational methods, reading lists, or third-party brand names is strictly for compatibility and organizational purposes. TiTo Tracker is not sponsored by, endorsed by, or affiliated with any corporate franchisor.

7. Account Termination & Updates

• We reserve the right to suspend or terminate accounts that engage in fraudulent activity, security compromises, or severe violations of these Terms.
• We may periodically update these Terms to reflect new features or legal requirements. Material updates will be reflected on this page with a revised date.
